Mr. Debabrata Chatterjee Mr. Kunal Ganguly ..for the State Learned senior counsel appearing on behalf of the petitioner submits as follows. It is alleged that the petitioner and his father engaged labour to illegally extract stones from a quarry. In the process, due to an accident six persons died. The petitioner's father being the principal accused was arrested and was thereafter granted bail.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He submits that the petitioner stands on the same footing as his father. No permission whatsoever was obtained to extract stones. He refers to relevant documents, land records and statements of witnesses including the statements of co-workers engaged in the illegal extraction by the petitioner and his father.

Considering the incriminating materials available in the case diary, I do not consider that this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
