No. 29 KAUSHIK REJECTED C.R.M.(A) 5426 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Patiram Police Station Case No. 187 of 2022 dated 25.09.2022 under Sections 21(c)/22(c)/23(c)/27A of the Narcotic Drugs and Psychotropic Substances Act.

And In Re : Nurna Bibi @ Nunna Bibi ...... petitioner Mr. Kaushik Chaudhury Ms. Busra Khatoon ....for the petitioner Ms. Faria Hossain Mr. Anand Keshari ....for the State There are materials in the case diary implicating the petitioner in the business of cross border drug trafficking. It is contended that, no narcotic was seized from the possession of the petitioner and that, the narcotic seized from the person arrested is below commercial quantity. However, considering the involvement of the petitioner in the incident as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 5426 of 2022 is dismissed.
