1. The petitioner's prayer for changing his nominee in his official records is alleged to be kept pending in the office of the Directorate of Pension, Provident Fund and Group Insurance.

2. The prayer of the petitioner was forwarded by the District Inspector of Schools (S.E), Malda to the Deputy Directorate of Pension, Provident Fund and Group Insurance vide communication no. 1075/H (MLD)/S.E dated 21st September, 2023.

3. None represents the State respondent.

4. Affidavit-of-service filed in Court today be kept with the records.

5. In the absence of any representation from the State, the Court is not in a position to decide the issue conclusively.

6. Accordingly, the instant writ petition stands disposed of by directing the respondent no. 5, Deputy Directorate of Pension, Provident Fund and Group Insurance to take a decision on the prayer of the petitioner in accordance with the prevailing Rules at the earliest but positively within a period of eight weeks from the date of communication of this order.

7. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
