The writ petition was lastly listed on 03.11.2010 and thereafter the petitioner did not pursue the matter.

I have considered the representation made by the petitioner to the Superintendent of Police, South 24-Parganas as also the subject-matter for which the present cause of action has been initiated. Having considered the same, I am of the view that there was a dispute between the two private parties in respect of an amount of their business. Having considered the subject-matter of the representation, I am of the view that the petitioner is entitled to have his remedies exhausted before other forum. The jurisdiction of this Court under Article 226 of the Constitution of India is not required to be applied in the facts and circumstances of this case.

Accordingly, WPA 22564 of is dismissed.

Pending connected application, if any, is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
