Mr. Sudipta Dasgupta Mr. Saikat Sutradhar .... For the Petitioners Mr. Mukti Chandra Mr. Dwaipayan Sanyal .... For the State Affidavit of service filed by the petitioners and report submitted by the State are taken on record.

The petitioners intend to organise a peaceful sit-in demonstration near Bikash Bhavan opposite to the statue of Dr. Bidhan Chandra Roy and adjacent to Central Park from 17th November, 2025 to 26th November, 2025 from 11 am to 4 pm on each date with and around 1000 participants. The petitioners undertake to comply with the relevant regulations in using the public address system and to conduct the programme in a peaceful, disciplined and orderly manner. Opposing such prayer learned counsel for the State submits that the area chosen by the petitioners is an extremely congested place and there shall be hindrance to free flow of traffic if such demonstration is allowed to be conducted there. Also, the petitioners propose to use micro phones which shall disturb the peace and tranquility of the area.

Upon consideration of the submission made on behalf of the parties this Court allows the petitioners to organise a peaceful sit-in demonstration on the foot path adjacent to

Central Park, Salt Lake from 17th November, 2025 to 26th November, 2025 from 11 am to 4 pm subject to the following terms and conditions:-

1. The number of participants shall not exceed 500 at any point of time;

2. The public address system shall be used within the permissible limits as prescribed by this Court as well as West Bengal Pollution Control Board;

3. Speeches capable of inciting violence, provocative speeches and abusive language will not be permitted;

4. The organisers and the volunteers shall be responsible for any violation;

5. The demonstration will be held in such a manner so as not to obstruct traffic/vehicular movement and also not to cause any road blockade;

6. The participants shall ensure that there is no damage to public property, assault on any Government employee or any other transgression of law;

7. The participants shall abide by the instruction of the on duty police officers & shall act in a manner to ensure that no inconvenience whatsoever is caused to the public at large;

8. The mobile phone numbers of at least 5 organisers shall be provided to the local police authority who may be contacted if situation so arises;

8. The participants shall disperse immediately within one hour of completion of demonstration on 26th November, 2025.

With the aforesaid directions and observations, the writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
