REJECTED C.R.M.(A) 4870 of 2023 In Re:- In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Contai Police Station Case No. 115 of 2023 dated 19.03.2023 under Section 420/406/409/467/468/120B of the Indian Penal Code and 21 of the Mines and Minerals Act. And In Re : Suman Panda ...... petitioner Mr. Soumik Ganguly Mr. Sourat Nandy Ms. Chandana Chakraborty Mr. Akash Lal ...for the petitioner Mr. Sabir Ahmed Mr. Sayak Ranjan Ganguly Ms. Srijani Ghosh Mr. T. ahmed Ms. Suman Biswas ....for the defacto -complainant Mr. Arijit Ganguly Mr. Avik Ghatak ...for the State The application for anticipatory bail is taken up for consideration subsequent to the order dated October 18, 2023 by the Coordinate Bench.

By such order dated October 18, 2023, the petitioner was enlarged on an interim anticipatory bail.

It is submitted at the bar that, the order granting interim anticipatory bail was passed just prior to the ensuing puja vacation without considering the materials in the case diary. We perused the materials in the case diary.

We find that the petitioner was an employee of HDB Financial Services. He was instrumental in forging No Objection Certificates or No Due Certificates of such Financial Institution and issued the same to borrowers. Although the present police complaint relates to only one account, investigation shows that the petitioner is involved in defrauding the bank on several accounts. The quantum of money so far discovered is in excess of Rs.50 lakhs. Considering the gravity of the offence and the involvement of the petitioner, we are unable to confirm the interim order dated October 18, 2023 or to grant anticipatory bail to the petitioner and the prayer of anticipatory bail is rejected. The application being CRM (A) 4870 of 2023 is dismissed. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
