Anirban Chakraborty v. State Of West Bengal And ORS.
19.11.2025 Item Nos. 1 Ct. No. 1 PG M.A.T. 1946 of 2025 Anirban Chakraborty Vs.
State of West Bengal & Ors.
Mr. Soumyen Datta Mr. Tapas Singha Roy Mr. Koushik Karmakar ..... for the appellant PER, SUJOY PAUL, ACJ..:
1. Mr. Datta, learned counsel for appellant is represented. Heard on admission.
2. This intra-Court appeal takes exception to the order dated October 31, 2025, whereby W.P.A.
20108 of 2025 was dismissed, which was filed against the intra-district transfer/posting of appellant from Alipore to Kakdwip.
3. Learned counsel for appellant argued the matter for quite some time.
4. This is trite that a transfer/posting order can be interfered with, if it runs contrary to any statutory provision (not policy guidelines), passed by incompetent authority, changes the service condition of an employee to his detriment and/or proved to be mala fide. The personal inconvenience cannot be a ground for interference.
5. Transfer is an incident of service. None of the ingredients on which interference can be made, could be established and therefore, we find no fault in the order of the learned Single Judge.
6. The intra-Court appeal is dismissed.
7. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
