The petitioner is aggrieved that the private respondent brother has effected construction over the joint property. He complains of inaction on the part of the Namkhana Police Station.

This Court is of the view that the petitioner has effective alternative remedy under Section 156(3) of the Cr. P. C.

There is a dispute with regard to the entitlement of the parties under the provisions of the West Bengal Land Reforms Act, 1955 as bargadar.

4.

The Police have referred the matter to the BL&LRO.

5.

The petitioner may seek remedies under the said statute, inter alia, before the WBLRTT.

6.

Report of the Police is taken on record.

7.

The writ petition is disposed of.

8.

There will be no order as to costs.
