The writ petition was listed lastly on 3rd November, 2010.

The grievance of the petitioner relates to an order passed in T.S.85 of 2010 by the learned Civil Judge (Senior Division), Ranaghat, Nadia.

Having considered the subject matter of the writ petition, I am of the view that this Court under Article 226 of the Constitution of India is not empowered to interfere in respect of the proceeding pending before a civil court when it is in seisin of the matter. Further, there was no persuation and the point of dispute relates to the order of 2010. Having considered the time period which has lapsed, no further cause of action survives.

Accordingly, the writ petition being WPA 22654 of 2010 is dismissed.

Pending connected application, if any, is consequently dismissed.
