The Commissioner of Police, Barrackpore has filed a report in the form of affidavit which is taken on record. 2.

It appears from the report that on complaints received from the petitioners prosecution nos. 508 dated 12.07.2024 and 545 dated 04.08.2024 have been taken under Section 506 of the IPC. It is further indicated by the Commissioner of Police that since thereafter, the police have not received any further complaint.

It appears, however, from the supplementary affidavit filed in Court today by the petitioners that a complaint dated 9th October, 2024 has been filed after the two prosecutions mentioned hereinabove have been made.

It is expected that appropriate steps are taken by the office of the Commissioner of Police to protect a bona fide citizen like the petitioners to lawfully ply their auto rickshaws.

It is also directed that the complaint dated 09th September, 2024 be registered as an FIR and appropriate steps be taken against the accused persons in accordance with law.

The petitioners may pursue further remedies in accordance with law with liberty reserved as above. 7.

In view of the aforesaid, CPAN 1488 of 2023 shall stand disposed of.

Rule, if any, shall stand discharged.

9.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
