1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is employed with the Indian Army. He has been falsely implicated in this case. The allegation of second marriage is bailable.

2. Learned counsel appearing on behalf of the de-facto complainant strongly opposes the prayer for anticipatory bail. She submits that the cruelty was inflicted upon the petitioner soon after marriage. The Stridhan articles were taken away by the accused. The husband finally deserted her and got married to another lady. Out of mental agony, the de-facto complainant suffered miscarriage.

3. Learned counsel appearing for the State vehemently opposes the prayer for anticipatory bail. He relies on the documents regarding the second marriage. He also relies

on the statements of witnesses, the seizure list and the documents pertaining to purchase of gold and other articles that were given as Stridhan. The petitioner has not cooperated with the investigation and has not responded to the notices given by the police. An allegation of attempt to murder has subsequently been added in the array of charges.

4. Considering the above, the other incriminating materials available in the case diary and the fact that the petitioner has not cooperated with the investigation, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

5. Accordingly, the application for anticipatory bail is rejected.
