The writ petition was filed when the West Bengal Administrative Tribunal was not in operation in view of the observations made by the Hon'ble Supreme Court in 2018 (16) SCC 341 [Rojer Mathew vs. South Indian Bank Ltd.] The petitioner is admittedly a retired employee of the Government of West Bengal. Any grievance relating to employment, therefor, is required to be ventilated normally before the West Bengal Administrative Tribunal.

The petitioner is granted leave to withdraw this application and file an application before the West Bengal Administrative Tribunal on the self-same ground. Since it is submitted by the petitioner that he has been superannuated during the pendency of the writ petition, the petitioner is also permitted to include

further grounds, if any, in connection with his grievance. The West Bengal Administrative Tribunal if approached within three weeks shall consider the matter on merits without going into the aspects of any delay due to the pendency of this writ petition. Nothing further remains to be adjudicated in this writ petition. The same is accordingly disposed of. (Arindam Mukherjee, J.)
