The revisional application has been preferred challenging the proceedings relating to complaint case no. C 86/13 pending before the Learned Judicial Magistrate, Bidhannagar, North 24 Parganas under Sections 196/199/200/209/468/471 read with Section 120B of the Indian Penal Code.

The record reflects that there was a direction by a Coordinate Bench on 2.9.2013 to effect service upon the opposite party. Subsequently, there has been no persuasion and the record do not reflect the present stage of the proceedings before the Learned Magistrate.

Having regard to the period of time which has lapsed in the mean time and the nature of the documents which are relied upon by the petitioner to rebut the contentions alleged in the petition of complaint, I am of the opinion that the documents so relied upon cannot be assessed by this Court as counter to the allegations in the petition of complaint at this stage. Thus no interference is called for.

Accordingly, CRR 2946 of 2013 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
