By the present writ petition, the petitioner seeks for his transfer from one District to another.

The petitioner contends that he is an Assistant Teacher at Gohalberia Primary School and is physically handicapped. The school where the petitioner is presently posted is 75 kms. away from his house. The petitioner made a representation before the West Bengal Board of Primary Education through the Belpahari Circle, Jhargram on 28th August, 2024. However, the same is still pending with the authority. Hence this writ petition. 3.

Mr. Firdous Samim, learned advocate appearing for the petitioner submits that the West Bengal Board of

Primary Education be directed to consider the representation of the petitioner for his transfer from Jhargram to Paschim Medinipur on medical ground. 4.

Mr. Ratul Biswas, learned advocate appearing for the WBBPE also submits that the matter be sent to the appropriate authority for due consideration.

In view of the submissions advanced by the respective parties, respondent no. 4, the Secretary, West Bengal Board of Primary Education is directed to consider and dispose of the representation of the petitioner dated 28th August, 2024 within a period of six weeks from the date of communication of this order subject to furnishing of all the documents by the petitioner in accordance with law. The petitioner is directed to produce all the relevant documents, if any, before the concerned authority.

The petitioner is directed to communicate this order to respondent no. 4, the Secretary, West Bengal Board of Primary Education for necessary compliance.

With the above directions, the writ petition being no. WPA 25892 of 2024 stands disposed of.

Since no affidavits have been called for, the allegations made in the writ petition are deemed to be not admitted. 9.

Consequently, connected applications, if any, also stand disposed of.

Interim orders, if any, stand vacated.

There will be no order as to costs.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Bivas Pattanayak, J.)
