Sukrit Roy The revisional application has been preferred challenging the order dated 30.4.2013 passed by the Learned Chief Judicial Magistrate, Murshidabad in connection with M.R. No.883 of 2010 under Section 125 of the Code of Criminal Procedure wherein the Learned Magistrate was pleased to award Rs.2000/- per month as maintenance. The petitioner being the husband was aggrieved by the order so passed.

I have considered the reasons assigned by the Learned Magistrate while arriving at his finding.

Further it has been observed by the Learned Magistrate that from the documents so relied upon and the oral evidence which was appearing before the Court, it transpired that the petitioner was working in Tata Motors and was earning approximately Rs.15,000/- per month.

Having regard to the fact that the learned Magistrate awarded a sum of Rs.2000/- per month as maintenance, considering the earning of the present petitioner I am of the opinion, no interference is called for.

Accordingly, CRR 2965 of 2013 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
