Petitioner is aggrieved by the fact that in spite of M/L. No.225 Rakib direction passed in T.S. 70/2009 the respondents violated the order of injunction and thereafter demolished the cowshed of the petitioner. To that effect information was sent to the police authorities but no steps were taken. Learned advocate for the State has submitted a report. Report reflects that on the complaint of the present petitioner on or about 30th September, 2024 an enquiry was conducted and in course of enquiry it revealed that a G.D. Entry being 335 & 341 dated 06.10.24 was registered in the regular general diary entry register, thereafter police authorities registered a case being Rajarhat PS case no. 460/24 under Section 223 of BNS.

Having considered that at the relevant point of time the police authorities had taken steps, I direct that the police authorities would only interfere in case of any violation of law and order. So far as the other issues are concerned, the petitioner will approach the Civil Court

which is in seisin of the T.S. 70/2009 for specific direction to be carried out by the police authorities. With the aforesaid observations WPA 26295 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
