To that effect, a complaint was lodged with the local police station on or about 2nd July, 2024. But, till date, the police authorities did not take any steps.

Mr. Banerjee, learned Additional Government Pleader, submits a report, which reflects that an enquiry was conducted and the outcome of the enquiry

was informed to the petitioner.

In view of the aforesaid, if the petitioner is aggrieved by the act and actions of the police authorities, he would approach the jurisdictional court under Section 175(3) of the BNSS and/or under Section 223 of the BNSS. The learned Magistrate would assess regarding the accusations and pass necessary orders by exercising his discretion.

In the meantime, it is directed that as the petitioner and the private respondents are at loggerheads, the police authorities would keep a strict vigil and ensure that no breach of peace and tranquility takes place as also no untoward incident crops up because of the inimical relationship between the parties.

With the aforesaid observations, WPA 26296 of 2024 is disposed of.
