Mr. Arunava Pati ...for the petitioner Mr. Supriyo Chattopadhyay Ms. Iti Dutta ...for the State The petitioner was arrested because of some criminal offence. The petitioner was a Shiksha Bandhu in Cluster Level Resource Centre, (CLRS) Simlapal.

The District Project Officer of Samagra Shiksha Mission, Bankura wrote a letter on 22.08.2019 to the State Project Director of Paschimbanga Samagra Shiksha Mission to know whether such a person who was in jail custody for more than two months can be allowed to join.

In reply, the State Project Director of the said Shikkha Mission through his letter dated 30.09.2019 has intimated, inter alia, as follows:

"The charges against him are known to all the people of the locality including the school children. Presence of such accused person is not desirable around educational institution and is likely to vitiate the environment of the school and also negatively

impact the minds of the children studying in the school".

This Court is in complete agreement with the view expressed by the State Project Director and no relief is granted to the petitioner by this Court. The writ application with prayer to join the CLRS is dismissed.
