Gangarampur Police has filed a report dated 11.12.2022 and the same is taken on record.

It appears that there is a long standing civil dispute between the petitioner and the respondent nos. 4 and 5.

It is further submitted that proceedings under Section 107 of the Cr. P. C. has been registered against the private respondents by the police.

Since insofar as the allegations of constructions over the PWD land, this Court directs the Executive Engineer, PWD, Balurghat Division to enquire into the matter and take appropriate steps on the constructions effected on the land-in-question by the private respondents. If it is found that the property-in-question in fact belongs to the P.W.D., appropriate proceedings may be instituted for eviction of unauthorised occupants and for demolition of unauthorised construction on the land-in-question.

Gangarampur Police shall ensure that there is no breach of peace in the area.

The writ petition is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official webside of this Court.
