Learned advocate appearing for the petitioners submits that from the possession of the petitioners the police authorities allegedly showed recovery of 670 bottles of Phensedyl. It has been submitted that there were two other individuals who have fled away from the place of occurrence, consequently, the petitioners having been arrested are detained for about nine months in custody. Although, charge-sheet has been submitted, till date charge has not been framed and there are 11 witnesses on whom the prosecution has relied upon. Learned advocate appearing for the State opposes the prayer for bail and submits that two accused persons are absconding and the trial of the case would commence immediately on arrest of the two accused persons.

Be that as it may, since there are 11 witnesses and till date their case has neither been split up nor absolute efforts have been found on behalf of the investigating agency, I am of the opinion that further detention of the present petitioners are unwarranted.

As such the petitioners namely, Alamgir Sk and Aktarul Sk @ Islam shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act and the Additional Sessions Judge, 5th Court, Berhampore, Murshidabad.

If on bail, the petitioners shall physically present on each and every date fixed by the learned trial Court. The petitioners shall attend once in a fortnight before the Inspectorin-Charge of Sagarpara Police Station or any Officer authorized by him till the said condition is modified by the learned Special Court.

Accordingly, CRM (NDPS) 1430 of 2025 is allowed. Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
