Rakib (Allowed) CRM (M) 2333 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Krishnaganj Police Station Case No. 398 of 2025 dated 23.09.2025 under Sections 103/238/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Haradhan Roy ......Petitioner.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 57 days and is innocent of the charges, as such he may be released on bail. Learned advocate further undertakes that the petitioner would cooperate with the investigation.

Mr. Chakraborty, learned advocate appearing for the State has opposed the prayer for bail and produced the Case Diary and drawn the attention of the Court to the relevant materials appearing in the Case Diary.

I have considered the Post Mortem report along with the statement of some of the witnesses. Having regard to the same as also the period of detention of the petitioner, I am of the opinion that further detention of the petitioner is uncalled for. Accordingly, the prayer for bail of the petitioner is allowed.

As such the petitioner namely, Haradhan Roy shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Krishnagar, Nadia. If on bail, the petitioner shall meet with the Investigating Officer of the case once in a week till the chargesheet is submitted before the jurisdictional Court. Petitioner shall not leave the jurisdiction of the District of Nadia without the prior permission of the learned Chief Judicial Magistrate, Krishnagar, Nadia Accordingly, CRM (M) 2333 of 2025 is allowed. Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
