Learned advocate appearing for the petitioners submits that the petitioners are in custody for about 76 days and they have been implicated in the instant case on the basis of statement of co-accused persons and there is no recovery from the possession of the petitioners, although the subject-matter of the case presently is restricted to recovery of 12 bottles of phensedyl.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that investigation of the case is still in progress and there are antecedents of the present petitioners.

Be that as it may, having regard to the period of detention of the present petitioners and the quantum of contraband recovered, I am inclined to release the petitioners

on bail. As such, the prayer for bail of the petitioners is allowed.

Accordingly, the petitioners viz., Ujjwal Mandal and Abhiram Mandal shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act, Malda. If on bail, the petitioners shall meet with the Inspectorin-Charge, Malda Police Station/Investigating Officer of the case till the submission of the charge-sheet. Since the investigation of the case is still in progress, it would be the discretion of the learned Special Court to impose further conditions as the learned Special Court deems fit and proper.

The application for bail, being CRM (NDPS) 1441 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
