The records of the case reflect that the revisional application has been preferred challenging the continuation of Mahishadal P.S. Case No. 332 of 2018 dated 26.12.2018, wherein the ld. ACJM was pleased to take cognizance of the offence. On receipt of the charge-sheet submitted by the investigating agency, documents have already been supplied to the accused persons, which the prosecution has relied upon to prove its case.

From 25.3.2019, more than four and half years have been passed and there has been no progress in the case

because of non-cooperation of the accused persons as reflected from the order-sheets.

Having considered the same, I grant liberty to the petitioner to take up the points canvassed in the present revisional application at the stage of consideration of charges by way of preferring an application under Section 239 of the Cr.P.C., if so advised.

With the aforesaid observations, CRR 4243 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
