This application under Section 482 of the Code of Criminal Procedure challenges the legality of complaint Case No. C2950/2008 under Section 138 of the Negotiable Instrument Act, 1881. Briefly stated Kotak Mahindra Bank Limited filed a petition of complaint against the petitioner under Section 138 of the Negotiable Instrument Act, 1881 before the learned Chief Metropolitan Magistrate, Calcutta.

Challenging the said proceeding the accused person filed this application under consideration on 25th September, 2008 but did not turn up since thereafter.

In such circumstances, I do not find any reason to invoke the jurisdiction conferred under Section 482 of the Code of Criminal Procedure as there is every reason to presume that over the period of 15 years since filing of this application, the proceeding before the learned Court has arrived at a logical conclusion. This revisional application is devoid of any merit and is dismissed.
