Mr. Samim Ahammed Mr. Arka Ranjan Bhattacharyya Ms. Gulsanwara Pervin ... for the petitioner Mr. Siddhartha Lahiri Mr. Debraj Dutta ... for the respondents In this writ petition the petitioner challenged a letter of termination dated November 11, 2022 issued by the Secretary-SBFC and SPO(HP) to the Senior Divisional Personnel Officer, South Eastern Railway. After filing of the writ petition the said letter of termination was withdrawn by an office order dated November 22, 2022 issued by the Senior Divsional Personnel Officer, Chakradharpur.

In view of such withdrawal of the letter dated November 22, 2022, the writ petition has become infructuous.

The issue with regard to termination is now settled between the parties. In the circumstances, WPA 25782 of 2022 is dismissed as not pressed. It is made clear that the petitioner will be at liberty to agitate his other prayer in the writ petition, if so advised.

Since no affidavit has been filed, all the allegations contained in the writ petition are deemed not to have been admitted by the parties.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.
