I find that all the accused persons who have preferred the revisional application have not signed the power and one single person signed the power and also written the names of all the accused persons. The petitioners are all accused persons. In a criminal case where substantive sentence and prescribed punishment is there, one cannot delegate the power, as such, the revisional application itself is not maintainable. With the aforesaid observations, CRR 4248 of 2023 is dismissed.

Pending application, if any, is also disposed of.

However, petitioners are granted liberty to file afresh.

Department is directed to return the certified copy to the advocate on record of the petitioners on the same being replaced by a Photostat copy.

Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
