Learned Advocate appearing for the petitioners submits that the police complaint was lodged 17 years after marriage. Third petitioner is the husband and is serving with the Indian Army. The other two petitioners are the parents-in-law of the de facto complainant.

The de facto complainant in her statement recorded under Section 161 of the Code of Criminal Procedure claims that she was assaulted and there as an attempt to strangulate her. There is an injury report of the de facto complainant which suggests that there was an incident of assault.

The son of the de facto complainant and the third petitioner who is a minor states that, the petitioners were involved in the attempt to strangulate the de facto complainant. Considering the gravity of the offence and the involvement of the petitioners therein, we are unable to grant anticipatory bail to the petitioners.

Prayer for anticipatory bail of the petitioners is rejected. CRM (A) 5448 of 2022 is dismissed.
