The petitioners are aggrieved that their pensionary benefit has not been fixed in terms of the letter dated July 19, 1996, issued by the Assistant Secretary, Higher Secondary Branch, School Education Department, Government of West Bengal, being annexure P/4 of the writ petition.
It is clearly mentioned in the said order of appointment that why their appointment shall be issued w.e.f. 15.02.1995, their pensionary benefit would get back to the initial appointment.
The initial appointment of the petitioner no.1, dated 12.09.1988, petitioner no.2, dated 25.08.1987 and petitioner no.3, dated 01.07.1987. In that view of the matter, the writ petitioners shall be entitled to pension upon superannuation. The pay scale and pensionary
benefit shall, however, be calculated on the basis of the last drawn pay of three persons.
With the aforesaid observations, the writ petition shall stand disposed of.
There shall be no order as to costs.
Notice issued through their counsel, is kept with the record.
Service book of the petitioners shall be rectified in terms of the aforesaid order.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
