This contempt application has been filed alleging that the appellant has not complied with the judgment in FMA 857 of 2022 dated 23.11.2022. However, the assessee in the said case was M/s. Tata Steel Limited & Ors. Against the said judgment The State had preferred Special Leave Petition being SLP No. 870 of 2023 and the said SLP has been dismissed as withdrawn by recording the submission made on behalf of the State that a settlement has been arrived at.

However, the learned Government Pleader appearing for the respondent on instruction submits that the appeal filed by the State concerning the present applicant namely BKB Transport Pvt. Ltd. is still pending before the Division Bench of this Court.

In the light of the above, liberty is granted to the applicant to move the said appeal and respondents are directed to serve a copy of the appeal along with annexures on the learned Advocate for the applicant herein within a week from date.

With the above observation, the contempt application stands disposed of.
