Petitioners are directed to serve a copy of the revisional application upon Mr. Sanjib Kumar Dan, learned advocate who usually appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioners submits that the warrant of arrest has been issued against the victim girl and her mother who are witnesses in the instant case being Saithia P. S. Case No. 55 of 2021 dated 02-04-2021.

The learned special court on non-receipt of the notice was pleased to issue non-bailable warrant of arrest against the present petitioners. The execution of said warrant of arrest against the present petitioner be stayed till 31st March, 2024. In the meantime, if the victim girl and her mother appear before the learned special court, the learned trial court/special court would recall the warrant of arrest.

Petitioners are directed to appear before the dates so fixed. In case the petitioners appear before the said date, the

learned special court would recall the warrant of arrest. With the aforesaid observations, the revisional application being CRR 4253 of 2023 is disposed of.

Pending applications, if any, are disposed of accordingly. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
