20.12.2022 sdas rejected C.R.M. (DB) No. 4131 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Cybar Crime Police Station Case No. 65 of 2022 dated 17.10.2022 under Sections 420/468/470/471/419/467/120B of the Indian Penal Code.

And In Re : Disha Dey Ghosh & Anr. ..... petitioners Mr. Goutam Banerjee .... for the petitioners Mr. Mr. Rudradipta Nandy, learned APP Mr. Sudip Ghosh Mr. Apurba Kumar Datta ..... for the State Learned Counsel appearing for the petitioners submits they are in custody for 70 days. It is also submitted that they were unaware of the illegal activities carried on at the call centre. They are mere employees. They pray for bail. Learned Counsel appearing for the State opposes the prayer for bail and submits the petitioners used to make fraudulent calls and induced innocent persons to part with their money.

We have considered the materials on record. Further investigation is in progress. Petitioners have been implicated in a number of cases involving similar allegations of fraud of innocent persons on the false promise of setting up 5G towers.

Under such circumstances, we are not inclined to grant bail to the petitioners at this stage.
