Sweta Gupta @ Sweta Singh ... petitioner Mr. Debnath Ganguly Mr. Supriyo Dutta Mr. Tushar Saha ... for the petitioner Mr. Bitasok Banerjee Ms. Sonali Bhar ... for the State Learned counsel for the petitioner submits that the present petitioner is in no way connected with the unfortunate incident of suicide of the alleged victim. In fact, in his dying declaration, the victim had stated that he had a relationship with a married lady named Puja. As the lady was not inclined to continue with such relationship, he committed suicide in front of the house of the said lady. At the end of the statement, suddenly the victim took the name of the petitioner and stated that if he died, the present petitioner would be held responsible.
Learned counsel for the State strongly opposes the prayer for anticipatory bail and submits that the said Puja had implicated the present petitioner as being responsible for the death of the victim.
It will be for the Courts to finally decide whether there is any element of abetment of suicide in this case. However, considering the materials available in the case diary and the alleged role ascribed to the present petitioner, I am inclined to grant anticipatory bail to the petitioner. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate witnesses.
The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
