For the State The petitioner is directed to serve upon Ms. Debjani Sahu, ld. Advocate, who ordinarily appears on behalf of the State. Her appearance may be regularised by the concerned authority.

The grievance of the petitioner is that the case was initiated in the year 2013 and till date the same is continuing before the ld. JM, 5th Court, Serampore, Hooghly. Ld. advocate for the petitioner submits that till date the examination of two of the witnesses have been completed and third witness has been partly examined. The manner in which the evidence is progressing before the ld. trial court, according to the petitioner, is a cause of worry, as more than ten years have passed since the initiation of the instant case.

Having considered the plight of the petitioner, I direct that the ld. JM, 5th Court, Serampore, Hooghly from

the next date would fix one date in every 15 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

The ld. trial court would be at liberty to issue notice upon the SDPO/ASP/DSP/DC in charge of Chanditala P.S., who would ensure regarding the availability of the witnesses on the date so fixed for examination.

In case, any witness is not available, in that case, a report should be submitted before the Court so that the same would enable the ld. Trial Court to proceed with the next stage. No unnecessary adjournment shall be given to either of the parties. All efforts be taken so that the trial of the case should be completed at the earliest. With the aforesaid observations, CRR 4252 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
