Bidhan Chandra Krishi Viswvidyalaya, Nadia (hereinafter referred to as the "BCKV" in short) by an order dated June, 23, 2009 had appointed the petitioners in the post of fieldman to render service in the "Comprehensive Scheme, Cost of Cultivation of Principal Crops in India" for a period of five months purely on contractual basis on a consolidated remuneration of Rs.6,000/- (Rupees six thousand) only per month.

The BCKV recently has decided to engage Manpower Agency to provide persons to serve as fieldman and for the said purpose has floated the tender dated October 31, 2025.

The petitioners are challenging the said tender notice.

Mr. Victor Chatterjee, learned advocate for the petitioners submits that his clients are working in

the project as fieldman since 2009 without any break at this stage the University cannot be allowed to outsource the Manpower to the detriment of the petitioners.

Ms. Lina Majumder, learned advocate for the University submits that the engagement of the petitioners were purely on contractual basis as such they cannot object to the policy of the University to engage Manpower Agency.

Mr. Animesh Mukherjee, learned advocate for the State argues in the same line. He submits that the petitioners being the contractual employees cannot interfere with the policy of the University.

Having heard the learned advocate for the parties and on perusal of the materials on record, it appears that the engagement of the petitioners was purely contractual and in view of such nature of engagement, it is not open to the petitioners to challenge the decision of the BCKV to engage Manpower Agency to get man support for the scheme.

W.P.A. 25778 of 2025 is therefore dismissed without any order as to costs.
