It is submitted by the Counsel for the Bank that in the year 2011 the loan account of the petitioner has since been assigned to an ARC.

In that view of the matter, the notice issued under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short SARFEASI Act, 2002) has become infructuous.

The writ petition has thus also become infructuous and is hereby dismissed.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
