In compliance with the direction dated November 12, 2024, Mr. Chattopadhyay, learned advocate for the District Primary School Council (D.P.S.C), Nadia, the respondent no. 6 herein files report of the Chairman of the said Council dated November 25, 2024, let it be kept with the record. It appears from the said report that the petitioner is a surplus confirmed teacher of the school where he is now working, the report further discloses that in the event the prayer of the petitioner is allowed, there would not be any adverse effect on the learning process of the students of the said school.

The representation of the petitioner to the said effect is pending consideration before the Chairman of the said Council, the respondent no.7 herein, the said representation dated September 13, 2024 is appearing at 'page 18' of the writ petition.

The respondent no.7 is directed to consider and dispose of the said representation in accordance with law within a period of eight weeks from the date of communication of this order, endeavour, however shall be made to place the petitioner in a school near to his residence.

WPA 26277 of 2024 is disposed with the above terms without any order as to costs.

Since no affidavit has been invited, the allegations contained in the writ petition are deemed to have been denied by the respondents.
