A report dated November 19, 2024 is filed on behalf of the Chairman, District Primary School Council, Purba Bardhaman, let it be kept with the record.

The petitioner is an Assistant Teacher at Mahata Dudhbagan Adibasi F.P. School, under Bhatar West Circle of the District Primary School Council, Purba Bardhaman, he is praying intra-district general transfer.

Mr. Mandal, learned advocate for the Council submits that he has the soft copy of the report of his client with him, which indicates that the petitioner is confirmed but a surplus teacher.

The grounds on which the transfer has been sought for, i.e. the distance between the school and the residence of the petitioner is more than 50 Kms and his wife is suffering from gynecological disorder are not very much convincing however, the representation of the petitioner dated September 08, 2024, which is pending before the Sub-Inspector of Schools, Bhatar West Circle, Purba Bardhaman, the respondent no.5 herein may be considered as he is a surplus teacher.

The respondent no. 5, on the said representation, shall prepare a report and shall forward the said report and the said representation to the Chairman, DPSC, Purba Bardhaman, the respondent no. 7 herein expeditiously.

The respondent no. 7 then, shall consider the said representation and shall dispose it of in accordance with law as expeditiously as possible, preferably within a period of six weeks from the date of receipt of it.

W.P.A. 26273 of 2024 is disposed of with the above terms without any order as to costs.

Since no affidavit has been invited, the allegations contained in the writ petition are deemed to have been denied by the respondents.
