The present writ petition of the year 2009 has been preferred praying for direction upon the respondents to recall the charge sheet dated 16.06.2009 and also cancelling the impugned punishment order dated 01.09.2006.

Learned counsel for the respondentFood Corporation of India has appeared before this Court today and filed the documents which shows that against an appeal from the order in the disciplinary proceeding the penalty order has been set aside. The said order has been challenged in the present writ petition.

The document filed by the respondent be kept on record.

Considering the said fact, it appears that the writ petitioner has received the relief

prayed for in the present case, the writ petition has now become infructuous.

WPA 20458 of 2009 is accordingly disposed of as 'infructuous'.

There will be no order as to costs.

All connected applications, if any, stand disposed of.

Interim order, if any, stands vacated.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties as expeditiously after due compliance.
