Mr. Kunal Ganguly ..for the Petitioner Mr. Manas Kumar Kundu ...for the State The writ petition pertains to publication of result of written test conducted by the respondent authorities for appointment in the post of Gram Sahayak in Haripur Gram Panchayat. The selection process was initiated in 2003 and it has been submitted by Mr. Kunal Ganguly, learned advocate appearing for the petitioner that the petitioner participated in the written test, but the result of such test was never published. It is also submitted on behalf of the petitioner that previously writ petition being WP 12871 (W) of 2004 was filed by the present petitioner on the selfsame prayer of publication of result of written test which was conducted for appointment of Gram Sahayak and the same was disposed of by a coordinate Bench by passing an order dated 2nd February, 2005.

In addition thereto, there is a statement in the writ petition that subsequently petitioner was asked by the panchayat authorities to produce the copy of the order passed on the previous writ petition which was accordingly complied with by the petitioner but subsequently, no steps were taken for publication of the result.

Mr. Manas Kumar Kundu, learned advocate appears on behalf of the State-respondents and submits that the selection process for appointment in the post of Gram Sahayak was conducted in 2003. Therefore, nothing remains to be decided in the writ petition and the writ petition has become infractuous.

This Court has considered the submission of the respective parties and also perused the order passed by a coordinate Bench on 2nd February, 2005. From the order dated 2nd February, 2005, it appears that the written test which was conducted for appointment of Gram Sahayak in Haripur Gram Panchayat was subsequently cancelled as it was recorded in the said order. In view of cancellation of the written test, respondent authorities are not required to publish result of such written test. Accordingly, nothing remains to be decided in the present writ petition and same stands dismissed. However, there shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
