None appears for the Panchayat and the private respondent despite service.

Learned counsel for the petitioner submits that the private respondent has been raising construction on wetland illegally. The representation submitted by the petitioner in this regard before the concerned authority on 29th August, 2024 is yet to be considered.

It appears from the report submitted by the State that the land in question falls under the East Kolkata Wetlands Management Authority, Government of West Bengal where no permanent construction is permissible.

In view of the above, this Court directs the SubDivisional Officer, Baruipur being the third respondent herein, to consider and dispose of the representation submitted by the petitioner dated 29th August, 2024 within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner and the private respondent, in accordance with law. In doing so, the

concerned authority shall assess whether the construction is being raised on wetland by the private respondent illegally. If the assessment is in the positive, necessary steps be taken in accordance with law at the earliest.

The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
