This application has been filed on 3rd September, 2024 for recalling an order of dismissal of the revisional application on 23.08.2024 since nobody appeared and despite the fact that the matter was listed under the caption 'For Dismissal'.

It is submitted by the learned advocate that they missed the list and as a result of which, nobody represented the petitioner before the coordinate Bench when the matter was called on and he has no intention or negligence for the same.

Heard the submission. Perused the record. The matter pertains to Public Premises (Eviction of Unauthorised Occupants) Act, and against an order passed by the City Civil Court,

the Estate Officer has come before this Court challenging the said order.

Since the matter pertains to Public Premises (Eviction of Unauthorised Occupants) Act, 1971, this Court is of the view that an opportunity of hearing should be given to the parties.

Accordingly, the prayer stands allowed. I.A. No. CAN 1 of 2024 is disposed of.

Let the matter be restored to its original file and number.

Let the matter in the monthly list of November, 2025 under the caption 'Old Hearing Matter'.
