Ct.No.28 as (Rejected) C.R.M. (DB) 4138 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ranaghat P.S. Case No.103 of dated 30.05.2020 under Sections 341/326/307/34 of the Indian Penal Code.
In the matter of : Khokan Durlav.
... Petitioner.
Mr. Prabir Majumder, Mr. S. Majumder.
...for the Petitioner.
Ms. Faria Hossain, Mr. Anand Keshari.
...for the State.
Petitioner is in custody for two and half years. He renews his prayer for bail.
Learned Advocate for the State opposes the prayer for bail. He submits charge has been framed and date has been fixed for recording evidence.
We have considered the materials on record. Bail prayer of the petitioner was rejected earlier on merits. Thereafter, charge has been framed and date has been fixed for recording evidence.
Under such circumstances, we are inclined to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
Trial court is requested to expedite the trial and conclude the same at an early date without granting unnecessary adjournments to either of the parties.
