Despite service, none appears on behalf of the respondent no.8.

Challenging the appointment of the respondent no.8, the petitioner approached the Sub-Divisional Officer, Kandi, Murshidabad. The allegation was that the respondent no.8 did not fulfill the eligibility criteria with regard to residential status.

It appears that a hearing was held on December 1, 2022 at 12.30 p.m. by the Sub-Divisional Officer, Kandi. The petitioner prays that the authority may be directed to pass necessary orders pursuant to the hearing already held. This writ petition is disposed of with a direction upon the Sub-Divisional Officer, Kandi, Murshidabad to act and proceed in accordance with law and pass a reasoned order pursuant to the hearing already held. If the authority deems fit, further hearing shall be given to the petitioner as also the respondent no.8. A reasoned order shall be passed and communicated to all.

The entire exercise shall be completed within a period of six weeks from the date of communication of this order. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
