1. All the learned counsel appearing on behalf of the parties to this contempt application are present.

2. Learned counsel appearing on behalf of the added alleged contemnor No. 3 has submitted a status report in connection with a direction of this Court on 8th August, 2025.

3. Learned counsel appearing on behalf of the alleged contemnor no. 3 has submitted a letter of the Executive Officer, Barrackpore Municipality dated 28th August, 2025 addressed to the petitioner/applicant of this application regarding assessment of market value to the tune of Rs.24,33,600/- (Rupees Twenty Four Lakh Twenty Three Thousand Six Hundred only) of the land incorporated by the Municipality.

4. Photocopy of the letter dated 28th August, 2025 of the Executive Officer, Barrackpore Municipality and the status report submitted by the added alleged contemnor No. 3 are taken on record.

5. Heard both sides.

6. Learned counsel appearing on behalf of the applicant submits that the assessment of the compensation has not been made under the procedure prescribed therefor.

7. However, learned counsel appearing on behalf of the applicant inclines to accept the amount without prejudice to the rights and contentions of the applicant.

8. Accordingly, the Executive Officer, Barrackpore Municipality is directed to make payment with all interest within six weeks from date.

9. With the above observation, CPAN 1700 of 2024 stands disposed of.
