Learned advocate appearing for the petitioner submits that the petitioner is in custody since 17.05.2024 and investigation of the case has not only been concluded, but charges have been framed and out of 21 witnesses proposed to be examined, 4 witnesses have already been examined. Learned advocate for the petitioner further submits that further detention of the petitioner is unwarranted in the facts and circumstances of the case.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there is a child witness who has vividly explained the incident. Petitioner was also identified in the T.I. Parade. Having considered the gravity of the offence, I am of the view that this is not a fit case for granting bail at this

stage. As such, the prayer for bail of the petitioner is rejected.

Learned Trial Court is directed to expedite the examination of the witnesses concerned, preferably ten more witnesses be examined by 30th June, 2026.

Petitioner would be at liberty to approach this Court, if the directions passed above are not complied with. The application for bail, being CRM (M) 2423 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
