The petitioner was granted statutory bail by the learned Chief Judicial Magistrate, Malda on 26th April, 2024 in G.R. case no. 7468 of 2023 upon furnishing two sureties of like amount, one of whom must be a public officer. The petitioner sought modification of the order before the learned Assistant Sessions Judge, 2nd Court, Malda which was turned down by an order dated 12th June, 2024 in Sessions Case no. 164 of 2024.
Learned counsel for the petitioner submits that the petitioner is still in custody since he is not able to furnish surety of public officer as directed by the learned Magistrate.
Since the petitioner has been granted statutory bail on 26th April, 2024 and is still in custody due to inability to furnish surety as directed by the learned Magistrate, the order dated 26th April, 2024 passed by the learned Chief Judicial Magistrate, Malda in G.R. case no. 7468 of 2023 be modified to the extent that the petitioner shall furnish two sureties of like amount, one of whom should be local. The other conditions for bail shall remain unaltered.
CRR 4596 of 2024 is disposed of.
