Dwivedi, learned counsel for the petitioner yesterday moved the court for inclusion of the matter in the list. According to Mr. Dwivedi, the matter is dismissed for default. He is seeking order for restoration of the same.

But upon perusal on record, I find that on 23rd September, 2021, the Coordinate Bench of this court dismissed the criminal revision on merit. Mr. Dwivedi did not bring the order of 23rd September, 2021 to the notice of this court and tried to mislead the court.

Mr. Dwivedi, learned counsel is directed to be careful, henceforth, while making submission. The petition filed for restoration of the criminal revision is dismissed, however, without cost.
