Vaisya Mr. Pinaki Bhattacharya ... for DPSC, North 24 Parganas As the petitioner was absent in the school from 30.07.1988 to 30.09.2004, the pension could not be given to him, as appears from the last paragraph of Annexure P-4 (at page 26). From that paragraph it appears that some requirements were not fulfilled and that is why the pension could not be granted. As the pension could not be granted for non-fulfillment of some conditions, there cannot be any question of payment of any family pension.

Hence, the writ application is devoid of any merit and same is dismissed.
