Case No. 152 of 2024 dated 20.08.2024 under Sections 420/406 of the Indian Penal Code, 1860. And In the matter of: Arpan Dey ....Petitioner.

Mr. Arindam Jana Mr. Yuvraj Chatterjee Mr. Akash Sarkar ....for the petitioner Ms. Sreyashee Biswas Mr. Soumya Basu Roy Chowdhuri ....for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an employee of a company and has no connection with the accused concern. The principal accused were arrested and thereafter granted interim bail. The petitioner only had certain loan transactions with the director of the accused concern. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the case diary including the FIR and the statements of witnesses including those of the victims. The prosecution case is that the petitioner and other accused had taken huge sums of money to arrange for foreign tours. After delayed availability of visa, when the victims were contacted them, they even avoided taking calls. They neither arranged for the trip nor returned the money. Other co-accused are in custody. There

are number of victims who have suffered similarly at the hands of the petitioner and the others.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
