Mr. Prantick Ghosh, Mr. Siddhartha Sarkar ...for the petitioner Mr. Mahamadul Hasan ...for the respondent no.4 Mr. Manas Kumar Das ...for the respondent nos. 6 to 11 The petitioner complains that the private respondent no.4, claiming to be her daughter-in-law, has been residing in their premises at Baganati, Post Office- Gopalpur, Police Station- Haroa, DistrictNorth 24 Parganas. The son of the petitioner is supposed to have got married to the 4th respondent in Bangladesh. Admittedly, the 4th respondent is a Bangaladesi National. The Visa indicates that she has entered India on a multiple entry medical Visa that originally expired on December 4, 2022 and was lastly extended until March 31, 2023.

It is ununderstood as to on what circumstances the petitioner continued to live in India or the nature of medical treatment she is undergoing here.

The Haroa Police Station shall cause enquiry and take up the matter with the concerned authorities under the Foreigners Act, 1946.

The petitioner shall be forthwith escorted back into her residence by the Haroa Police Station. In the event it is found that the 4th respondent is not entitled to live in India or is guilty of violation of the Foreigners Act, the Haroa Police Station shall take immediate steps in that regard.

Since the petitioner is otherwise uncomfortable with the 4th respondent, the 4th respondent shall make alternative arrangement to reside elsewhere in accordance with law.

Copies of the Visa and Passport of the 4th respondent are kept with the record.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
